What does no fault insurance mean?

"No fault insurance" is a term that is used to describe any car insurance system that:
  • Requires drivers to carry insurance for their own protection
  • Places limitations on their ability to sue other drivers for damages
With no fault laws, in an accident, your car insurance company will pay for your damages up to your policy limits and any other drivers involved will be covered by their car insurance company.

Under such a strictly no fault system, drivers would be completely covered by their own policy and would not be allowed to ever sue another driver for damages. However, no state uses such a strict no fault system. Instead, all "no fault" states have actually implemented a hybrid system with various parts of a true no-fault system and various parts of the standard liability system (which hold everyone responsible for the cost of damages they cause).

The states that have implemented some form of no-fault insurance can be very expensive. Therefore if you live in one of these states, it is even more important to make sure you shop around for your car insurance needs.
